About Eviction Compensation in Ontario
Under the Residential Tenancies Act (RTA), landlords in Ontario must compensate tenants when terminating a tenancy for specific reasons:
- N12 (Personal Use): If you or a purchaser require the unit for personal use, you must give the tenant 1 month's rent as compensation, or offer them an acceptable alternate unit.
- N13 (Demolition or Conversion):
- For buildings with 1 to 4 units: 1 month's rent compensation is required.
- For buildings with 5 or more units: 3 months' rent compensation is required.
- N13 (Extensive Repair or Renovation):
- For buildings with 1 to 4 units: 1 month's rent (or compensation equal to the time the unit is under repair, whichever is less).
- For buildings with 5 or more units: 3 months' rent (or compensation equal to the time the unit is under repair, whichever is less).
